Epic Ocean is an online platform that provides a directory of ocean activities, including but not limited to fishing charters, snorkeling tours, cruises, dive centers, and other marine-related services. We connect users with service providers and facilitate the discovery and booking of ocean activities.

We act as an intermediary platform and do not own, operate, or control the third-party services, activities, or businesses listed on our platform. We are not responsible for the quality, safety, legality, or any other aspect of the services provided by third parties.

3. Eligibility and Account Registration

To use certain features of our Service, you must:

Be at least 18 years of age (or the age of majority in your jurisdiction)
Have the legal capacity to enter into binding contracts
Provide accurate, current, and complete information during registration
Maintain and promptly update your account information
Maintain the security of your account credentials

When you book or engage with a third-party service through our platform:

You enter into a direct contractual relationship with the third-party service provider
We are not a party to any agreement between you and the service provider
We are not responsible for the quality, safety, legality, or any aspect of the third-party services
Any disputes, claims, or issues must be resolved directly with the service provider
We are not liable for any loss, damage, injury, or death resulting from your use of third-party services

You acknowledge and agree that participation in ocean activities involves inherent risks, including but not limited to risks of injury, death, property damage, and other hazards. You voluntarily assume all such risks and agree that we shall not be liable for any consequences arising from your participation in such activities.

7. Payments and Refunds

If you make a booking or purchase through our Service, payment processing may be handled by third-party payment processors. You agree to provide accurate and complete payment information and authorize us or our payment processors to charge your payment method for all fees and charges.

All fees are non-refundable unless otherwise stated or required by law. Refund policies, if any, are determined by the individual service providers, not by Epic Ocean. We are not responsible for processing refunds for third-party services.

You are responsible for any taxes, fees, or charges imposed by any governmental authority in connection with your use of the Service or purchases made through the Service.

8. Intellectual Property Rights

The Service, including its original content, features, functionality, design, logos, trademarks, and other intellectual property, is owned by Epic Ocean and its licensors and is protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Reverse engineer or attempt to extract the source code of the Service

Remove any copyright, trademark, or other proprietary notices from the Service

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes in accordance with these Terms.

9. Disclaimers and Limitation of Liability

9.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT:

The Service will be uninterrupted, secure, or error-free
Defects will be corrected
The Service or servers are free of viruses or other harmful components
The information on the Service is accurate, complete, or reliable

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL EPIC OCEAN, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

Your use or inability to use the Service
Any conduct or content of third parties on the Service
Unauthorized access to or alteration of your transmissions or data
Statements or conduct of any third party on the Service
Any other matter relating to the Service

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE USE OF OR ANY INABILITY TO USE THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, IN THE TWELVE (12) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the above limitations may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless Epic Ocean, its affiliates, directors, officers, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable attorneys' fees, arising out of or relating to:

Your use of or access to the Service
Your violation of these Terms
Your violation of any third-party right, including intellectual property, privacy, or publicity rights
Your User Content
Your participation in any ocean activities or use of third-party services
Any injury, death, or property damage resulting from your use of third-party services

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination:

Your right to use the Service will immediately cease
We may delete your account and all associated data
All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability

You may terminate your account at any time by contacting us or using account deletion features, if available.

12. Dispute Resolution and Governing Law

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign or transfer these Terms or our rights and obligations hereunder without restriction.

13.5 Force Majeure

We shall not be liable for any failure or delay in performance under these Terms due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, pandemics, or failures of third-party services.
